Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Inverse Analytics portal and the services made available through it (together, the “Service”). The Service is operated by Inverse Analytics (the “Company”, “we”, “us”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service provides quantitative energy-market analytics for power markets. The Service is provided for professional, informational purposes only. We may add, change or discontinue features at any time.
2. Eligibility and accounts
- Access requires an account provisioned for you. You may use the Service only if you can form a binding contract and are acting in a professional capacity.
- You are responsible for keeping your credentials confidential and for all activity under your account. Accounts are personal and must not be shared or transferred.
- Notify us promptly of any unauthorised use of, or security breach affecting, your account.
3. Acceptable use
You agree not to, and not to permit any third party to:
- copy, resell, sublicense, redistribute or make the Service or its outputs available to any third party, except as expressly permitted in writing;
- reverse-engineer, decompile or attempt to derive the underlying models, source code or data of the Service;
- scrape, harvest or use automated means to extract data beyond the interfaces we provide;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service, its infrastructure, or other accounts;
- use the Service unlawfully or in breach of applicable market-abuse, competition or data-protection rules.
4. Intellectual property
The Service, including its software, models, methodology, text, design and all outputs, is owned by the Company or its licensors and is protected by intellectual-property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Service and its outputs for your own internal business use. No other rights are granted.
5. No investment advice
The Service is an analytics and information tool. Nothing it provides constitutes investment, trading, financial, legal or tax advice, nor an offer, recommendation or solicitation to buy, sell or hold any energy product, financial instrument or position. All trading and business decisions you make are your own, taken at your sole discretion and risk. Past or simulated performance is not indicative of future results.
6. Data sources and accuracy
The Service relies on open data and on statistical models. Outputs are estimates that may be delayed, incomplete or inaccurate, and open data may be revised. We do not warrant the accuracy, completeness, timeliness or fitness of any data or output, and we are not responsible for open sources or their availability.
7. Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be suspended for maintenance, updates or reasons beyond our reasonable control.
8. Disclaimer of warranties
To the maximum extent permitted by law, the Service and all outputs are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, trading losses, data or goodwill, arising out of or in connection with your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Confidentiality
Non-public outputs, analytics and materials made available to you through the Service are confidential to the Company. You will not disclose them to any third party without our prior written consent, except as required by law.
11. Suspension and termination
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination (including sections 4, 5, 6, 8, 9 and 10) will survive.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we update the version and effective date above; where a change is material, we will take reasonable steps to notify you. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
13. Privacy
Our processing of personal data is described in our Privacy Notice, which forms part of your use of the Service.
14. Governing law
These Terms are governed by the laws of Italy, without regard to conflict-of-law rules, and the courts of Italy have jurisdiction, subject to any mandatory consumer-protection or other rights available to you under applicable law.
